These Terms and Conditions (“Terms”) govern the use of the mobile application “YDKast” (the “App”), operated by Telepoint , a company duly incorporated under the laws of Curaçao, having its registered office at Caracasbaaiweg 199A, Curaçao (“Company”, “we”, “us”, or “our”).

By downloading, installing, accessing, or using the App, you agree to be legally bound by these Terms. If you do not agree, you must immediately discontinue use of the App.

1. Description of the Service

The App is a digital media aggregation platform providing streaming access to multiple radio stations, news articles, video content, PDF publications, and other third-party multimedia content. The Company operates as an intermediary digital distribution platform.

2. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction). If under 18, parental or guardian consent is required.

3. User Accounts

Where registration is required, users must provide accurate information and maintain confidentiality of login credentials. The Company may suspend or terminate accounts for violations of these Terms.

4. Radio & Content Licensing

The App may include radio streams, news publications, videos, and PDF documents provided by third-party content providers pursuant to licensing or distribution agreements. All intellectual property rights remain with the respective rights holders. Access does not grant rights to reproduce, redistribute, re-broadcast, modify, or commercially exploit such content. The Company may remove content upon legal request or termination of licensing agreements.

5. Intellectual Property – Platform

All proprietary rights in the App software, source code, branding, layout, and infrastructure remain the exclusive property of the Company or its licensors.

6. Permitted Use

Users may not download radio streams, reproduce PDFs without authorization, reverse engineer the App, circumvent security measures, or use the App for unlawful purposes.

7. Data Protection & GDPR Compliance

Personal data is processed in accordance with the National Ordinance on the Protection of Personal Data (Curaçao) and the EU General Data Protection Regulation (GDPR), where applicable. Users located in the EU have rights of access, rectification, erasure, restriction, objection, and portability.

8. Cross-Border Data Transfers

Personal data may be processed outside the EU subject to appropriate safeguards including Standard Contractual Clauses or other lawful transfer mechanisms.

9. Advertising & Analytics

The App may display advertisements and use analytics technologies. Where required, consent is obtained before activating non-essential tracking technologies.

10. Disclaimer of Warranties

The App and all content are provided ‘AS IS’ and ‘AS AVAILABLE’. The Company does not guarantee continuous availability or accuracy of third-party content.

11. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for indirect, consequential, or incidental damages. Nothing excludes liability for fraud or intentional misconduct.

12. Indemnification

Users agree to indemnify and hold harmless the Company from claims arising out of misuse of the App or violation of these Terms.

13. Copyright Complaints

Allegations of copyright infringement must be submitted in writing to support@ydkast.com with sufficient detail for investigation.

14. Termination

The Company may suspend or terminate access for violation of these Terms or for legal compliance reasons.

15. Governing Law & Jurisdiction

These Terms are governed exclusively by the laws of Curaçao. Disputes shall be submitted to the competent courts of Curaçao.

16. App Store & Google Play

If downloaded via Apple App Store or Google Play, platform providers are not responsible for the App. Use must comply with respective platform terms.

17. Amendments

The Company reserves the right to amend these Terms. Continued use constitutes acceptance of revised Terms.
